E2 Visa

An E2 visa treaty investor visa is a non-immigrant visa that allows foreign nationals who have a treaty of trade with the United States to lawfully stay and work here in the United States if the foreign national invested or is actively in the process of investing a substantial amount of capital in a United States Business that currently exists or is in the process of creating a new United States Business. A foreign national granted an E2 visa can bring their spouse and children to the United States as well as an essential skilled worker or as an executive or supervisor position as long as he or she is a national of the treaty country. An E2 visa holder may be admitted for 2 years and can apply for an extension of stay up to 2 years at a time.

  1. Be a national of a country with which the United States maintains a treaty of commerce and navigation
  2. Have invested, or be actively in the process of investing, a substantial amount of capital in a bona fide enterprise in the United States. The foreign national must show that the capital was not derived from a criminal activity.
  3. Be seeking to enter the United States solely to develop and direct the investment enterprise. This is established by showing at least 50% ownership of the enterprise or possession of operational control through a managerial position or other corporate device
